Terms of service

These Terms of Service govern access to and use of giltandgravity.com and related services operated by Gilt & Gravity, a sole proprietorship operated by Kevin Beaumier. By using the Services, you agree to these Terms. Mandatory consumer rights remain unaffected.

Eligibility and accounts

You must have legal capacity to enter into a contract in your jurisdiction or use the Services with the authorization of a parent or legal guardian. You are responsible for the accuracy of information provided, the security of account credentials, and activity under your account.

Store information

We aim to present product descriptions, materials, dimensions, colours, images, pricing, and availability accurately. Screen settings and production variations may cause minor differences. We may correct errors before or after an order, subject to applicable law, and will contact you if a correction materially affects your purchase.

Orders and payment

Submitting an order is an offer to purchase. An automated acknowledgment does not necessarily mean the order has been accepted. Acceptance occurs when we confirm fulfillment or shipment, subject to payment authorization, availability, verification, and applicable law. We may limit quantities or refuse orders for legitimate reasons, including suspected fraud or resale, and will issue any required refund.

Prices are shown in Canadian dollars unless indicated otherwise. Applicable taxes and shipping charges are displayed at checkout. You authorize the selected payment provider to charge the total accepted at checkout.

Shipping and returns

Our Shipping Policy and Refund Policy form part of these Terms. Delivery estimates are not guarantees. Ownership and risk are governed by applicable law and the agreed delivery terms.

Jewelry care and use

Follow product-specific care and safety instructions. Keep small jewelry components away from young children and pets. Discontinue use if a product causes irritation. Product materials and dimensions shown on the product page should be reviewed before purchase.

Intellectual property

The Services and their branding, text, graphics, photographs, video, designs, logos, and other content are owned by or licensed to Gilt & Gravity and protected by applicable intellectual-property laws. You may use the Services for personal, non-commercial shopping only. No content may be copied, modified, distributed, sold, scraped, or exploited without written permission, except as permitted by law.

User content

If you voluntarily submit a review, photo, comment, or other content, you confirm that you have the necessary rights and that it is lawful and accurate. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, and display it in connection with the Services and marketing, subject to applicable privacy law. We may remove content that violates these Terms.

Prohibited conduct

You must not misuse the Services, violate law or third-party rights, introduce malicious code, attempt unauthorized access, interfere with security, impersonate others, submit false information, scrape data at scale, or use the Services for fraud or unlawful activity.

Third-party services and links

The Services may rely on or link to third parties, including Shopify, payment providers, and carriers. Third-party services are governed by their own terms and privacy practices. We are not responsible for independent third-party content or conduct, except where applicable law provides otherwise.

Disclaimers and limitation of liability

To the fullest extent permitted by law, the Services are provided on an “as available” basis. We do not exclude or limit any legal warranty or liability that cannot lawfully be excluded. Subject to that rule, Gilt & Gravity is not liable for indirect, incidental, special, or consequential loss arising from use of the Services. For Québec consumers, these limitations do not apply where prohibited by the Consumer Protection Act or other mandatory law.

Indemnity

To the extent permitted by law, you agree to indemnify Gilt & Gravity for third-party claims caused by your unlawful use of the Services or material breach of these Terms. This section does not apply where prohibited by consumer law.

Changes, severability, and waiver

We may update these Terms prospectively by posting a revised version. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. A failure to enforce a provision is not a waiver.

Governing law

These Terms are governed by the laws of Québec and the federal laws of Canada applicable there, without depriving consumers of mandatory protections or jurisdictional rights available under applicable law.
